]]>Sher was conferred with the Prime Ministerial position using Article 76(5) of the Nepali constitution. He was appointed as PM after Supreme Court’s mandamus secured 165 votes in parliament. Sher needed 138 votes to win the vote of confidence in parliament.
During the vote of confidence, a total of 249 parliament members were present in the House of Representatives (HoR) on Sunday. While 83 parliamentarians vote against Sher, 165 parliamentarians voted in his favor. Only one member stayed neutral during this vote session.
With this victory, Sher will effectively stay as Prime Minister of Nepal until the next general elections are held in 2023. The positive development was taken cognizance by Indian Prime Minister Narendra Modi as he took to Twitter to congratulate Sher.
“Congratulations Prime Minister @DeubaSherbdr and best wishes for a successful tenure. I look forward to working with you to further enhance our unique partnership in all sectors, and strengthen our deep-rooted people-to-people ties,” Modi tweeted. The Indian PM is the first leader to congratulate Sher Deuba’s victory.

]]>In his petition, senior advocate Dinesh Tripathi argued that the president could not appoint these officials without a parliamentary hearing on the dissolved House of Representatives.
He urged the court to release an interim order stopping the officials from work until a final verdict on the case is completed.
Earlier on June 24, President Bhandari appointed 20 officials in various constitutional commissions in line with the recommendation by the Oli-led government.
A Constitutional Council meeting chaired by PM Oli on May 9 had recommended the names for these positions. Though the Constitution says that the officials should be appointed after a hearing by the Parliamentary Hearing Special Commission, President Bhandari appointed the officials.
This has triggered controversy across the country, and Supreme Court has registered the writ petition.
Moreover, the Oli-led government had passed an ordinance to hold council meetings even without the presence of opposition party leaders. This ordinance facilitated the Oli-led government to hold council meetings amid differences with council members, including Speaker Agni Prasad Sapkota and the main opposition leader Sher Bahadur Deuba. Opposing the ordinance, several writ petitions are filed at the Supreme Court.

]]>PM’s cabinet is left with five central ministers, including Oli himself, taking cognizance of the interim order.
The interim order was issued by a division bench led by Chief Justice Cholendra Rana and Justice Prakash Dhungara. They issued this order after several writs were petitioned against the cabinet expansion, which happened in the initial weeks of June.
The writs opined that the government had assumed the caretaker status due to the announcement of elections. This announcement doesn’t allow the PM to appoint new ministers as it infringes upon the constitution.
The remaining cabinet members, other than Oli, are Bishnu Paudel, Basanta Kumar Nembang, Lila Nath Shrestha, and Krishna Gopal Shrestha.

]]>The PM will also address a mass public meeting to be organized in Dhangadhi, said Prime Minister’s Press Advisor Surya Thapa in a Facebook message.
This is the first time that the Oli-led faction is organizing a mass assembly outside Kathmandu after the dissolution of the House of Representatives (HoR).
Industry Minister Lekh Raj Bhatta, Labor Minister Gauri Shankar Chaudhari, Forest Minister Prem Ale, and General Administration Minister Ganesh Singh Thagunna are at the location for the last four days to make preparations to present over 50,000 people in the open forum.
Meanwhile, the security has been tightened at the location ahead of PM Oli’s visit. Chiefs of Nepal Police, Armed Police Force, and Nepal Army have arrived at the airport in the morning today. A large number of security personnel have been deployed from the airport to the open forum.
Earlier on Wednesday, a provincial committee meeting of the Oli-led faction of the NCP extended the provincial committee to a 551-member committee. The meeting also elected Industry Minister Lekh Raj Bhatta as the Chief Coordinator of the Sudurpashchim Province.
The Election Commission (EC) on Thursday ordered both the factions of the National Communist Party (NCP) to send revised reports within seven days.
The Commission sent separate letters addressing PM Oli and Kamal Dahal, the chairpersons of two factions of NCP, in line with Rule 25 (4) of the Regulations for Political Parties, 2074 BS.
“If the situation arises that no name, statute, stamp, flag, and election symbol of the party can be changed, the Commission gives a seven-day deadline to the concerned groups to resend the amended details,” states the Rule.
Both the factions have been claiming the legitimacy of the NCP after the party was split into two with the HoR dissolution by PM Oli.

“A cabinet meeting is taking place at 11 AM today. Minister Khatiwada will tender his resignation in the meeting,” said sources.
Earlier on March 3, Minister Khatiwada had resigned from his post after his two-year term in the National Assembly was expired.
However, President Bhandari reappointed Khatiwada as Finance Minister within 24 hours of resignation, as per Article 78 (1) of the constitution.
As per Article 79 of the constitution, the Cabinet Ministers who are not members of the House of Representatives (HoR) or the National Assembly (NA) should be appointed to either House within six months after assuming a portfolio.
But the possibility of Khatiwada to continue his services as Finance Minister has nullified as the recent Secretariat Meeting of NCP has decided to take Party’s Vice-chairman to the National Assembly.
According to the sources, Vice-Chairman Bamdev Gautam, General Secretary Bishnu Paudel, and Standing Committee members Janardan Sharma and Surendra Padey are in the run for the Finance Minister post.

1) Posting content on social media sites that may pose a threat to the sovereignty, security, unity or harmony of the country: Fine up to Rs. 1.5 million or jail term up to five years or both
2) Found guilty of cyberbullying: Fine up to Rs. 50,000 or 6-months jail term or both
3) Deleting or interfering with information stored in somebody’s computer: Three (3) years jail term
The bill facilitates the Department of Information Technology with the authority to impose excessive restrictions on social platforms and increase surveillance on personal data.
The tabling of the bill led to a tussle between House of Representatives (HoR) and Nepali Congress lawmakers.
NC member Ram Bahadur Bista said that the bill is against the people’s freedom of expression and opinion.
He exclaimed that the bill is bad for democracy and against the spirit of constitution.
Executive Director of Freedom Forum Taranath Dahal said that the bill has 0-12 clauses that restricted the freedom of expression.
He further expressed his fear that the HoR will try to pass other restrictive bills ignoring the opposition lawmaker’s voice.
“With this bill, the ruling party will have unfair advantage to suppress the voice of people using social media sites to express their dissatisfaction on the governmental works,” he said.
The Nepal IT Bill 2019 will replace the prevailing Electronic Transaction Act, 2006.

]]>Ending an age-old system, a new bill related to the election of members of the House of Representatives has barred the practice of single candidate contesting from more than one constituency.
The said provision, under the Article 14 of the newly-proposed bill, is planned for implementation in the upcoming election to be held under the First-Past-The-Post (FPTP) election system. Any candidacy that fails to follow the provision will be cancelled.
The candidate in race for the FPTP election will not be eligible for inclusion in the closed list of proportional nominees and the proportional representation name list is limited to only one candidate per political party.
As per the Bill, the government plans to conduct the local, provincial and federal elections within the stipulated time frame (January 21, 2018).
Marking a historical judgement, the Bill proposed a right-to-reject provision for the directly-elected members of the House of Representatives in parliamentary elections.
The Bill also proposes to conduct a re-polling by canceling the ongoing or recently-held election results, if a polling station is captured or ballot papers are found destroyed in the process of counting votes.
As per the Constitution, 65 out of 275 members of the House of Representatives will be elected through the FPTP system, while the remaining 110 will be through proportional representation.
