Previously, 136 parties existed in the country.

The Commission stripped the parties of their recognition after failing to present their audit reports for three years.

In addition, the Commission has stipulated that none shall use the names, flags, and symbols of the disbanded parties for one year.

Raj Kumar Shreshta, the Commission Spokesman, stated that office bearers of the scrapped political would have to submit NPR 50,000 to Election Commission. “In order to prevent the central office bearers and members of the dismissed parties from becoming office-bearers of other parties for a period until the fine is collected, it has been decided to proceed with the proceedings in accordance with the law only after registering a new party and updating the existing parties,” said Shrestha.

Earlier, the Commission was lenient enough to ask 86 political parties to clarify their stance after failing to submit audit reports for three consecutive years.

As per the Political Parties Act 2073, political parties must share their income and expenditure details to EC and submit them to the Commission a month after their audit is complete. This submission has to be done 6 months ahead of the fiscal year expiry.

On September 26, 2018, EC decided to collect information from political parties that failed to update the regulatory with their property details.

However, only 31 out of the 127 parties registered with EC have reported the status of their property detail submission, so far.

Background

According to the Nepal Act on Amendment & Integration of Political Parties 2017, central officials and members are required to submit property details to the party office within 60 days of being elected to the post.

The respective party’s central office has to publish names of members who submitted property details and those who failed to do so even one month after deadline.

In the event of failure to comply with the regulation, EC has the authority to fine the party member or official with NPR 10,000 fine. Additionally, the concerned party is fined with NPR 5000 if the details are not published in time.

Progress So Far

EC Deputy Attorney General Ghanashyam Ojha said that most parties informed the election authority that they started collecting details from their central committee member while some others already collected them.

“However, all four ‘national’ parties’ represented in the House of Representatives—Nepal Communist Party, Nepali Congress, Rastriya Janata Party-Nepal and Sanghiya Samajwadi Forum-Nepal—informed us that their central committee members had submitted property details and that they had put up a notice on their notice board,” Ojha added.

Interestingly, all four national parties submitted details after the deadline.

EC’s Decision

The election authority will crosscheck authenticity of all the provided information after Tihar festival, Ojha said.

A report will be compiled, based on the information provided. “The meeting of commissioners will decide on what to do regarding the parties who failed to notify the EC within the deadline,” Ojha added.

These include National Assembly Members Election Bill-2075, Commission on Investigation of Enforced Disappeared Persons (CIED) and Truth and Reconciliation (First Amendment) Bill -2075 and other bill pertaining to the job descriptions and benefits of the House of Representatives (HoR) Secretary and National Assembly Secretary-2075.

HoR passed the transitional justice bill in a meeting on July 02, 2018.

The bill entitled ‘Enforced Disappearances Enquiry, Truth and Reconciliation Commission (First Amendment) Bill’ replaces the ordinance formed by the erstwhile Deuba-led Nepal Government and extends the tenure of two transitional justice mechanisms: Truth and Reconciliation Commission (TRC) and CIEDP.

Prior to the latest move, both the houses have passed the bill and had sent it to President Bhandari for endorsement.

So far, CIEDP has received a total of 3,093 complaints, of which, it recommended 2,258 complaints for detailed investigation after completing preliminary investigations, and more than 250 complaints are currently under detailed investigation.

On the other side, there are also 60,000 complaints on TRC table and 7,000 of them are currently under investigation. The commission has set up at least one office in every province for the task.

Landmark Bill Receives Nod

In another major parliamentary update, the long-awaited landmark National Medical Education Bill-2075 also received a nod recently for further approval through ordinary legislative procedure.

The government placed the Bill in the House on July 01, 2018 and has been taken ahead for parliamentary process with all-round support from all political parties including opposition for its endorsement.

As a replacement to the National Medical Education Ordinance issued by the government around eight months ago, the new Bill is being considered as the need of the hour for the nation towards addressing issues in the field of country’s medical education and healthcare sector as a whole.

This update comes as a good news for all the related stakeholders including doctors from reputed medical and healthcare departments of the country who have been relentlessly fighting for reforms in medical education the same led by the country’s renowned surgeon and social activist KC Govinda.

Business Advisory Panel Soon

Nepal Parliament is also ready to approve a new Business Advisory Panel that will be live very soon.

The Parliamentary Secretariat has already received names of lawmakers from the country’s political parties including opposition, which will be presented at the Parliamentary Public Hearing Committee by end of the day of July 03, 2018.

We have asked the parties to submit names of lawmakers in order to form various parliamentary panels as soon as possible, says Krishna Bahadur Mahara, Parliament Speaker 

According to HoR Secretary Gopal Yogi, the committee is most likely to be formed on July 04, 2018, which is also the deadline for all the parties to submit the names of recommended lawmakers to be represented in the committee.

In an official press release on December 12, 2017, the agencies lauded political parties, voters and citizens for their successful participation in the parliamentary and provincial elections held on November 26, 2017 and December 7, 2017, respectively.

The presence and participation of senior citizens, women, as well as differently-able people were equally encouraging, read an official statement.

The election observation body comprises of General Election Observation Committee (GEOC), National Election Observation Committee (NOEC) and Inclusive Women Network for Peace, Justice and Democracy (Sankalp).

Observation Teams Across Polling Centers

All the observation teams contributed their best to the fair conduction of electoral process.

While NEOC deployed a total of 3,743 trained observers, Sankalp had set up 910 observers followed by GEOC (800 observers) in both the first and second phase of elections.

Besides, these teams also deployed mobile observer and election expert teams across the sensitive polling centers to ensure free and fair electoral process.

In addition to these, NEOC had alsomobilized 165 long-term observers for data-based observation of both the election phases.

Besides deploying teams across the districts, the observation body had also set up call centers to avoid discrepancies in the polling process.

EC Promises Met 

On the flip side, the elections also reported violation of election code of conduct despite strict arrangements by EC.

“In many places use of pamphlets and campaign materials were found to be in violation of the code of conduct.  Data received from NEOC Call Center state that in 82 polling centers observed campaign materials were found within the 300-meter perimeter of the polling centers. Moreover, there were activities aimed at influencing voters outside 12 polling centers,” read a statement.

Overall, 99.60 percent (1307) of the polling centers had a minimum 6-member staff as promised by EC, 99.20 percent (1301) had clearly-marked ballot boxes, 0.40 percent (5) centers reported lack of necessary election material and 0.50 percent (6 centers) saw confidentiality failure, informed the observers.
