In this regard, local governments and community forest users have opposed to the draft bill.<\/p>\n
Tulsipur Sub-metropolitan City Mayor Ghanshyam Pandey said that the bill was being used by bureaucrats who favored the unitary system of governance.<\/p>\n
\u201cThe bill was drafted without consulting the political leadership,\u201d he added.<\/p>\n
He further said that bureaucrats introduced provisions that would allow unethical officials to misuse government funds and cause irregularities.<\/p>\n
“If this bill is enacted into law, it will only benefit bureaucrats,\u201d Pandey said.<\/p>\n
What Industry Experts Have to Say?<\/strong>
\nFederation of Community Forestry Users – Nepal (FECOFUN) members met lawmakers and parliamentary panels to remove unethical provisions from the bill.<\/p>\n\u201cThe bill intends to centralize powers in the federal government without trying to share them with provincial and local governments. It reflects the government\u2019s unitary mindset. It is against the constitution\u2019s spirit because all three tiers of government \u2013 federal, provincial and local \u2013 have rights over forest resources,\u201d said Bharathi Kumari Pathak,<\/span> Chairperson, FECOFUN.<\/p><\/blockquote>\n\u201cThe federal government should have consulted provincial and local governments before preparing the draft. Socio-economic conditions have changed and communities can commercialize their forest products. The bill has to give more powers to community forest users for their benefit,\u201d said Shambhu Dangal<\/span>, a forest expert.<\/p><\/blockquote>\n\u201cForests will not be preserved if community users don\u2019t benefit from forest products, while advocating that the bill should not be curtailed.\u201d<\/p>\n
Forest and Environment Ministry Under Secretary Binod Devkota however says that the government had not proposed curtailing of CFUG rights.<\/p>\n
He adds that community forest products prices will be determined in a separate forest rule. Devkota said the bill will act as an umbrella law, enabling provincial and local governments local to enact their own forest laws.<\/p>\n
He said that the bill also envisages to invest 50 percent forest income into poverty alleviation program.<\/p>\n
According to Forest Department statistics:<\/strong><\/p>\n\n- About 35 percent of Nepal\u2019s population is involved in community forestry management programs<\/li>\n
- So far, 19,361 CFUGs have been formed and the government handed over 1,813,478 hectares of national forests to communities<\/li>\n
